- 1900-1940-
Summary
Question: Is Perry entitled to receive an amount in legal tender currency in excess of the face amount of the bond? Conclusion: No. In a 5-4 decision, Justice Charles E. Hughes wrote the majority opinion. The Supreme Court held that Perry was only entitled to the dollar amount of the bond, not the weight of the gold. Perry failed to show that the change in coin weight had cause him any actual damages. Justice James C. McReynolds wrote a dissent stating that the Court was allowing the Government to ignore the contractual obligations to its benefit.
